If you work in civil litigation, this CPD will explain the key requirements for disclosure and inspection of documents in the different tracks and courts. We will also discuss the professional requirements owed by lawyers to the court in relation to disclosure and how disputes are resolved.
The course starts with a short (11 minutes) topic recording introducing the frameworks for disclosure and inspection and explaining the procedures and the exemptions for certain types of documents. We go on to examine in more detail the terminology used and the obligations of the parties at different stages in the claim to disclose documents. We discuss how the requirements differ, including under the disclosure pilot in the Business and Property Courts, before reviewing the requirements for inspection.

If you work in civil litigation and advise clients on the options for recovering debts, this CPD will explain the options for enforcing them through the courts, taking account of the debtor’s assets and other relevant issues.
The course starts with a short (8 minutes) topic recording introducing important initial considerations before going through the main methods of enforcement and outlining some alternative methods. We go on to examine in more detail how to find out information about a debtor and the main method of enforcement available, including taking control of goods and third party debt orders. We will briefly examine some alternative methods of enforcement and consider the advantages and disadvantages of the different options.
