CILEx looks forward to responding to the Ministry of Justice’s consultation on Personal Injury reforms. But as ever, CILEx’s priority is to ensure access to justice is protected; whilst it is right that the problems of fraudulent claims and a compensation culture are addressed, changes made to tackle these issues should not be at the expense of genuine claimants struggling with serious injuries sustained through no fault of their own. Those victims will simply not pursue any claim or effectively become litigants in person, with all the attendant risks that brings to the justice system. Without access to legal advice, such people could be even more vulnerable to the fraudsters whom the reforms are designed to neutralise.
